Inherited a Home? Here’s How to Keep It Safe from Squatters

When a Georgia family lost their father, they thought they’d be closing a chapter by selling the home he built with his own hands. Instead, they faced a nightmare. Strangers moved in overnight, changed the locks, destroyed cameras, and even threatened the family with rifles when they came to check on the property.

To make matters worse, the squatters began promoting a VIP pool party at the home. They advertised food trucks and paid parking—all while having no legal right to be there.

Situations like this used to take months to resolve. Thankfully, a law passed in 2024 is finally giving property owners the tools to fight back.

Squatters Used to Have The Upper Hand

Until last year, Georgia laws made it hard to remove squatters quickly. If someone claimed to have a lease—even a fake one—it triggered a long eviction process. Law enforcement couldn’t do much without a court order.

As a result, many owners, especially those who inherited homes, were left helpless. They had to spend time and money just to prove what should have already been clear.

The Squatter Reform Act

In response to growing abuse, Georgia passed the Squatter Reform Act in 2024. Now, in 2025, we’re seeing its full impact.

Here’s how it works:

  • If a person has no valid lease or documentation, law enforcement can immediately issue a criminal trespass citation.

  • Squatters have 3 days to vacate the property if they are unable to show valid documents.

  • If a squatter presents a fake lease, it becomes a felony charge, not just a civil matter.

  • If a lease is presented, the case goes before a magistrate judge within 7 days.
